Terms of Service

The terms that apply when you buy and use an OzESim travel eSIM.

Last updated:

1. Who we are and when these terms apply

OzESim is operated by pr0d pty ltd trading as OzESim.io, ACN 702 491 638, in New South Wales, Australia. In these terms, “OzESim”, “we”, “us” and “our” refer to that business. Contact us at support@ozesim.io.

These terms apply to purchases through our website and supported applications. Read them with our Privacy Policy, Refund Policy and the description of your selected plan. By placing an order, you agree to these terms. Nothing here excludes, restricts or modifies a consumer guarantee or other right that cannot lawfully be excluded, including under the Australian Consumer Law.

2. Who may purchase

You must be at least 18 years old and legally able to enter into an agreement, or a parent or guardian must place the order on your behalf. You must be authorised to use the payment method and provide accurate purchaser and contact details.

Before buying, check that your device supports eSIM, is not carrier-locked, and supports the destination and plan you select. If our description or advice about compatibility is incorrect, your consumer-law rights still apply.

3. What your eSIM includes

We arrange travel eSIM connectivity through eSIM Go and its mobile-network partners. The selected plan determines the countries covered, data allowance, validity, supported networks and any fair-use restrictions. Unless a listing expressly says otherwise, plans are data-only and do not include a local telephone number, ordinary voice calls or SMS.

Each eSIM is intended for one compatible device. Family and sports package names do not mean multiple eSIMs or a shared data pool unless expressly stated in the listing. A sports-package name does not by itself indicate endorsement by an event organiser, club or league.

Plan validity and expiry follow the activation rules for the selected plan. Installation or registration on an eligible network may start a plan before you actively browse. Read the activation instructions and contact us if the start or expiry rules are unclear. Do not assume an unused plan can be kept indefinitely.

4. Orders, prices and payment

Prices are shown in AUD. Before you place your order, we display the total payable to OzESim, including GST where applicable and any other charges payable to us. Your bank or payment provider may separately charge currency-conversion or international-transaction fees.

Payments are processed by Stripe. Your bank or payment provider may apply its own terms. We do not store your full card number or card security code.

An order is confirmed after successful payment and our order confirmation. We may need to verify payment or investigate suspected fraud. If we cannot supply a paid order, we will notify you and arrange the refund or other remedy required by law.

Promotional prices can change before an order is placed. If an offer price has changed, we ask you to review the current price before payment rather than charging a different price without your agreement.

Our travel eSIM purchases are one-off purchases, not subscriptions, unless we clearly disclose and obtain agreement to a recurring arrangement. Free Explorer enrolment does not create a paid subscription or extra charge.

5. Delivery, installation and activation

Once payment is confirmed and the eSIM is provisioned, we send installation details to the email address provided. They may also be available through the order page. Provisioning and delivery can take time; a missing email alone does not establish that the eSIM has not been issued. Check your spam folder and contact support before purchasing again.

Installation details include a QR code and manual activation code, with direct-install links where supported. Direct installation currently requires iOS 17.4 or later on iPhone; Android support varies by device. If a link does not work, use the QR or manual installation method.

Keep activation links, QR codes, activation codes and order references private. They can enable another person to install or access the eSIM. Installation credentials may be single-use, and deleting a profile or changing devices may prevent reinstallation. Contact us before deleting an eSIM.

Install using a stable internet connection and follow the instructions, including enabling data roaming for the travel eSIM when appropriate. Your primary SIM may still incur charges from your home carrier; those charges are separate from our service.

6. Coverage, speeds and fair use

Coverage and speed vary with location, signal, device, network conditions and congestion. Network availability may change, but this does not remove our obligation to provide the service as represented or your consumer-law remedies.

Hotspot and tethering availability depends on the selected plan and the applicable network partner’s fair-use conditions. Some plans may not support hotspot or tethering. Check the plan details or contact us before purchase if you need this feature.

“Unlimited” does not necessarily mean unlimited full-speed data. Daily or total full-speed allowances, throttled speeds and reset periods apply where disclosed. For example, Unlimited Lite plans may provide 1 GB at full speed per 24 hours, then reduced speeds until the next activation-based daily reset. Read the restrictions shown for the actual plan you buy.

Do not rely on a travel data eSIM as your only way to make emergency calls. Maintain another suitable means of communication.

7. Acceptable use

We or our network partners may restrict service where reasonably necessary to address unlawful use, security threats or a material breach. Where practicable and lawful, we will explain the reason and allow a reasonable opportunity to resolve the issue. A restriction does not cancel any remedy we owe you under law.

  • Use the service lawfully and follow the applicable network and fair-use conditions.
  • Do not commit fraud, interfere with networks, attempt unauthorised access, or use the service to distribute unlawful or harmful content.
  • Do not resell or distribute eSIM installation credentials without our written permission.

8. Refunds and Australian Consumer Law

We do not offer change-of-mind refunds, including for unused or unactivated eSIMs. This is not a blanket “no refunds” policy. Refunds, replacements, cancellation and other remedies remain available where required by Australian Consumer Law or another applicable law.

The remedy for a problem depends on the nature and seriousness of the failure. You may also have rights to compensation for reasonably foreseeable loss or damage. Our Refund Policy explains how to ask us for help. Activation, use of data or purchase of a discounted plan does not automatically remove these rights.

Contact OzESim directly about a problem with your purchase. We may coordinate with suppliers, but will not require you to pursue them instead of exercising your rights against us.

9. Privacy and Explorer

Our Privacy Policy explains how we handle purchaser, payment-reference, eSIM, usage and support information, and any optional notification data.

Explorer is an optional free enrolment recorded with your purchase. Enrolment is not, by itself, consent to receive marketing. Purchase and service communications may be sent as needed to fulfil and support your order. Any marketing must have a lawful basis and an appropriate way to opt out.

Commercial electronic messages are sent only with consent as required by law, identify us as the sender and include a functional unsubscribe facility in accordance with the Spam Act 2003 (Cth).

10. Responsibility and liability

We remain responsible for the obligations and remedies that applicable law places on us. We do not exclude liability for fraud, misleading conduct, consumer guarantees or any other liability that cannot lawfully be excluded.

To the extent permitted by law, we are not responsible for loss caused solely by your unlawful use or misuse, or by ignoring reasonable installation or compatibility instructions. This does not apply to a failure for which we are legally responsible. Network-partner involvement is not a waiver of your rights.

11. Changes to plans and these terms

We may update our catalogue and these terms for future purchases. The version in effect when you place an order applies to that order, unless a change is required by law or separately agreed with you. Changes are not applied retrospectively to remove accrued rights.

We will display the updated date and, where appropriate, give notice of material changes. Keep a copy of the terms and plan information applicable to your purchase.

12. Governing law, complaints and contact

These terms are governed by the laws of New South Wales and Australia, subject to any mandatory consumer protections that apply to you. The courts of New South Wales have non-exclusive jurisdiction; this does not prevent you using another forum available under applicable law.

For support or a complaint, email support@ozesim.io with your order reference and a description of the issue. We will consider your concerns and respond within a reasonable time. You may also seek assistance from NSW Fair Trading or an appropriate consumer regulator. The ACCC provides guidance and accepts reports, but does not resolve individual disputes.
